GENERAL TERMS AND CONDITIONS OF USE AND SERVICE OF ITUP.

1. INTRODUCTION

1.1. Purpose of the Document
These General Terms and Conditions of Use and Service (hereinafter, the «Terms») govern access to and use of the ITUP. platform and any service, content, functionality, or transaction offered through the website www.itup.host and any other associated digital application (hereinafter, the «Site» or the «Platform»).

Any person (hereinafter, the «User») who accesses, registers, or uses ITUP’s services agrees to be bound by these Terms, as well as the Privacy Policy, Payment Terms, and Community Guidelines, which are an integral part of this document.

If the User does not accept these Terms, they must refrain from accessing or using the Site.

2. DEFINITIONS

For better understanding of these Terms, the following definitions apply:

  • «User»: Any individual or legal entity who accesses, browses, registers, or uses the Platform.
  • «Employer»: A registered User who posts job opportunities or hires professionals through the Platform.
  • «Freelancer»: A registered User who offers professional services through the Platform.
  • «Project»: A job opportunity posted by an Employer on the Platform.
  • «Custom Offer»: A proposal sent by a Freelancer in response to a Project posted by an Employer.
  • «ITUP Secure Payment»: The integrated payment processing system on the Platform.
  • «Services»: All activities and functionalities offered by ITUP.

3. REGISTRATION AND ACCOUNT CREATION

3.1. Registration Requirements
To use ITUP, the User must:

  • Be at least 18 years old and have the legal capacity to enter into contracts.
  • Provide truthful, complete, and up-to-date information during registration.
  • Maintain the confidentiality of their login credentials.
  • Not share or transfer their account to third parties.

Failure to meet these requirements may result in account suspension or deletion by ITUP.

3.2. User Responsibility
The User is responsible for:

  • All activities carried out under their account.
  • Immediately notifying ITUP of any unauthorized use of their account.

ITUP will not be liable for damages resulting from unauthorized use of an account.

4. PROJECT POSTING AND MANAGEMENT

4.1. Posting Projects
Employers may post job opportunities that meet the following requirements:

  • Clear and detailed description of the Project.
  • Defined budget and deadlines.
  • Prohibition of including external contact information (emails, phone numbers, external links, social media).

ITUP reserves the right to remove any Project that does not meet these requirements or violates the Community Guidelines.

4.2. Offers and Project Acceptance

  • Freelancers may send Custom Offers in response to posted Projects.
  • Employers may select an offer and formalize the hiring.
  • Once a Project is accepted, both parties are obligated to comply with the agreed terms.

5. PAYMENT AND BILLING

5.1. Use of ITUP Payment System
All payments must be made through the ITUP Secure Payment system.

It is strictly prohibited to:

  • Request or make payments outside the Platform.
  • Share private banking information in messages or descriptions.

Violation of this rule may result in account suspension and possible legal action.

5.2. Fees and Commissions
ITUP charges fees for using the Platform:

  • Freelancers: A commission of XX% on received payments.
  • Employers: Processing fees, if applicable.

5.3. Refunds
Refunds will only be processed under justified circumstances and at ITUP’s discretion.

6. INTELLECTUAL PROPERTY RIGHTS

6.1. Ownership of Delivered Work

  • Intellectual property rights of the delivered work belong to the Employer, unless otherwise agreed.
  • If the Freelancer wishes to retain any rights, they must communicate this before accepting the Project.

6.2. Content Use
The User grants ITUP a limited license to use the content published on the Platform for promotional and operational purposes.

7. USER CONDUCT AND COMMUNITY GUIDELINES

Users must maintain professional and respectful behavior. It is strictly prohibited to:

  • Request external contact information.
  • Use offensive, discriminatory, or harassing language.
  • Post fraudulent or misleading content.
  • Attempt to bypass ITUP’s payment system.

Violation of these rules may result in sanctions, suspension, or account deletion.

8. MODIFICATION OF TERMS

ITUP may update these Terms at any time. Continued use of the Platform after an update will be deemed acceptance of the changes.

9. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the country where ITUP is incorporated. Any dispute shall be resolved through the competent courts of that jurisdiction.
